CLASS ACTIONS & CATASTROPHIC PERSONAL INJURIES:

At Knight Palmer, we take great pride in leveling the playing field for those who need the law the most.

Many of our cases have involved catastrophic personal injury. For example, Jonathan Palmer obtained a $3 million settlement on behalf of a client who sustained a broken leg and other injuries when a distracted driver crossed the centerline and hit him head-on. He also helped represent the parents and estate of a young man who was killed by a drunk driver, obtaining a judgment of more than $10 million from the bar that plied the driver with alcoholic drinks long after she became inebriated.

Knight Palmer’s personal injury cases don’t always involve car accidents. We also routinely represent those injured by a defective drug or other product. For example, our lawyers were involved in the Fosamax cases on behalf of clients who suffered femur fractures after taking that drug, and we currently represent the husband and estate of a woman who died after using Johnson and Johnson talc products for most of her life.

In addition to personal injury cases, Knight Palmer also handles cases on behalf of consumers. Most of these cases are class actions designed to right wrongs that individual plaintiffs could not sue to address on their own. These class actions are highly complex, involving tens of thousands of consumers and schemes most often designed by the defendants to keep their frauds from being detected. We have become especially adept at cutting through the morass and identifying the claims and issues that matter most. This ability has contributed to the recovery of tens of millions of dollars on behalf of various classes. For example, Mr. Palmer was instrumental in obtaining a $52 million settlement and another $15 million settlement on behalf of thousands of merchants who had been paying fraudulent charges to their credit card processing companies. He also was involved in securing multimillion-dollar settlements on behalf of classes of contractors that had been charged improperly inflated repair costs by utility providers.

Knight Palmer’s attorneys also have considerable experience representing patients injured by the negligence of doctors or other medical professionals. We helped obtain a favorable settlement on behalf of a young woman who was left in a persistent vegetative state after nurses did not properly respond to her cardiac arrest. And, we currently are representing the family and estate of a man who was killed by an infection that he would not have contracted were it not for the negligence of the hospital medical staff.

A few other examples of Knight Palmer’s personal injury and class action experience include:

  • Obtained a $52 million settlement on behalf of a class suing credit card processors for fraudulent charges.

  • Obtained a $15 million settlement on behalf of another class suing a different credit card processor to recover hidden charges.

  • Obtained a $6.5 million settlement on behalf of a class of contractors suing a utility provider for fraudulently inflated repair costs.

  • Obtained a $500,000 settlement in a medical malpractice case against a hospital that failed to diagnose and treat a life-threatening situation.
